The Drama Just Gets MORE Intense

I have asked Delfts to post this for me, as I am at work and do not have access to my site.

The situation on the cars gets even murkier after talking to Allstate. Delfts called the claims number this morning to see why we had not heard from an adjuster yet. The woman on the line informed him that because a) we did not know the identity of the driver, and b) there was no way to verify his insurance coverage or lack thereof, Allstate was "Not Allowed" to pay our claim under state law.

Now, to begin with, the only reason we maintained the Uninsured Motorist portion of our policy was to protect us from uninsured motorists. It has been our experience in the past, with acquaintances and co-workers, that if the identity of a driver in a hit and run could not be established, this portion of the policy would repair or replace the damaged autos, pay medical bills, etc, until the other driver could be identified and either his insurance tapped for the bill, or the driver sued for the damages by the insurance company.

It seems that is not the case at all. No longer do they consider the probability that a hit and run driver IS a hit and run driver primarily because he DOESN'T have insurance.

Had only the ancient Tempo been affected by the automotive carnage in my driveway, I would never have even made a claim against my policy. The car was old, it had served us well, and we had more than gotten our initial investment out of the little thing. But when all of them were not only damaged, but damaged to the point that they were, we had no choice but to fall back on the coverage we thought we had and had paid for monthly.

There is something decidedly wrong with this. If in fact it is a part of state law, then this is a bad law. If on the other hand it is not based in actual law, Allstate needs to make good on a policy that was purchased in good faith.

I hate the prospect of calling a law office to run this by them. The very thought of having to litigate this sickens me. But it seems I have been left with no alternative in this matter.

I do know one thing. I will be seeking new coverage for whatever vehicle I am able to find, and it will not be with Allstate unless this is either proven to me to be true or settled to my satisfaction.

I don't know what state yer in, but you can go to findlaw.com and click around and get your state's searchable General Statutes. Just search through the Statutes main index and you should find the insurance laws pretty easily.

Or ask Allstate to name the relevent Statutes, title and section, that they claim disallow them from covering the damage.

This is such a crock! I dumped Allstate long ago after they started raising rates on an increasingly older vehicle... haven't heard any good things since.

I'm sorry for you, and I really hope you find a way to squeeze your money out of these assholes.

I have this idiot ex who owes me money which I kind of have blown off about ever getting back. Well, he gave a call today to apologize for being such an ass and how he misses me and blah blah. (He goes through these revelations every 3 months). Allowed him to chat more than normal. Maybe I can sweet talk my ex waste of time to pay up some. I never counted on seeing the money anyway, but...if I do get it, it's yours as well. Anything else, you let me know.

Myself, I'm also too poor to afford the "OR", so I'm just Po'.

But I'm going to try and get a little out to you this week so you and dm can at least have a pizza and bottle of Chianti and relax a little from this nightmare.

I am so sorry to hear about this! OMG - what a nightmare! First of all - don't wait, get on the phone to the State's Attorney. Tell them the type of insurance you carry and tell them that Allstate is NOT giving you the service you are paying for!!! Don't bother calling Allstate back until after you have talked to them. See if they are perpetrating an illegal act. See if you can get some guidance on how to handle this. After you've called the State's Attorney and found out your options... then call Allstate back. I hate to say, we've had them for years covering our vehicles - I think it's time for us to move on to some other company. Holy smokies!!!

Allstate sucks. I dropped them years ago. I recommend calling your homeowner's insurance (I hope to hell that's not Allstate, too) and make a claim with them. If they pay and Allstate owes, they'll go after Allstate and save YOU a lot of hassle.

Mama, when you're comparison shopping for a new insurance carrier, do be sure to check out www.electricinsurance.com -- this company is underwritten by General Electric and used to be available only to employees. They went public several years back. We've been with them for about 5 years now, auto and homeowner's both, and I can't tell you how many of our friends and family have switched after hearing what we pay and then getting their own quotes.
